Seems to of opened a can of worms. I expected some debate but I want to get it right up front, rather than make 7 changes over 1 week for various reasons. First and foremost for me is victims of crime.

Whilst I can understand other views and feel they are entitled to them in relation to their own loved ones been punished for years and or life in jail….

The bottom line is most guilty people will lie to the death, to their loved ones and anyone else who wants to hear them over their crimes and or involvement and culpability…

Did you get cut off from your say in Court?

Do you folks agree with me. I often receive letters/emails from victims and or the survivors left behind after awful crimes, long after the media has dropped off and moved to the next story. I am very aware that a lot of folks do not feel they get a real say. Now I cannot promise or even to offer that they will here, but I can say is a lot of readers come here every day and feel the same way as I do, and feel for victims of crime.

I propose to allow privately verified victims and family members to have a unique opportunity to have their say and let others know what the courts or media denied them. I think they have a right to be heard and I am having an educated guess that all the readers here and subscribers and other twitter folks etc. would be more than willing to receive, accept and share those so important feelings that often get ruthlessly cut off by media and or courts as if irrelevant or not important.

Well if the victims feelings on a crime is not important than who is. The welfare of the crim inside jail? Whether his or her telly is big enough?

I am not interested in those scum bags but am in voicing the victims and their families.

If I read my audience here correctly I am pretty sure the majority will agree with my view and we can facilitate a way to make this happen for folks. We have a good readership of people who care so please come forward and email me with your stories.

I will always treat you with the respect and PRIVACY YOU DESERVE, but if you wish to announce things to the world things the courts or media did not or wouldn’t cover, here is your chance.

At least here you know thousands of people will be reading your important statement each week. And not be written off as “Irrelevant” by some crusty old JUDGE

You will have the option if you want to allow comments to your statement or Not!

  1. One think I meant to add yet might edit, is whether or not to let these victims have their say and that’s it. Or whether we allow comments.

    Because the last thing I want to see here is the whining and whinging from convicted criminals families talking rubbish in support of the convicted...

    Something to ponder, but I envisage screening every single comment into this section before I allow its publication.

    WE are not here for the perpetrators (and sadly nor their often innocent families unfortunately)

      1. Welcome to our playground, Ziggy. This is where everyone can air their grievances from past experiences, discuss current crimes and have an open debate about most things. There are a few here that are more vocal than the rest ( self included ), but the contributors posting on this site are quite mature with regards to their approach to specific and sensitive topics so please feel free to give us your views and thoughts, we always need a fresh way of viewing things. As for your question, ” i would like to know if those who post here would consider the wrongly convicted as victims of crime? “, I’m pretty positive that everyone will be with me on this, I believe the wrongly convicted are probably the ‘ forgotten ‘ victims of crime. Everyone sees the affected people and families, the heartache stories on the current affairs programs etc, but noone really spares a thought for those that are wrongly convicted. I think this is because of 2 reasons. 1. The wrongly convicted is usually some poor bugger that was somehow pinned with the guilty tag whether by a false confession, poor witness accounts and evidence, or they’ve been blamed to put an end to a situation to ease public perception as ‘ someone is trying to get re-elected ‘, and once they’ve been found innocent, most of these unfortunate individuals just want to get back to living their lives without much fanfare at all. 2. With regards to being found not guilty and their subsequent release, some of the wrongly accused are given ‘ hush money ‘ and / or made to sign a contract or something similar stating that they won’t drag their case through the media etc, or something to that effect. They’re only my opinions from what I’ve heard, read and been witness to, and I don’t know how correct they are, but I’d like to think that that there are only very few wrongly convicted individuals in jail, but if you ask them, they’re all innocent.

      3. i only asked as my partner was wrongly convicted in march 2010, and sentenced in january 2011, he served 13 months before he was acquitted. his name was surpressed due to the charges being sex offences, as was the hearing where he was acquitted – only we were listed for hearing in that building for the whole day! we were not offered any ‘hush money’ to go away, they covered legal fees but only after our QC reminded them to do so. i would love to tell our story in the media and have the dogs that did this to us dragged through the mud, the only reason the girls charged him was for a victims of crime payment. our daughter was born while he was in jail, we found out i was pregnant 2 weeks after he went in, i visited him every week and all the nasty comments we both put up with from the jail was horrible, he wasnt even allowed to call me while i was in labor. the summary judgement is available online, i wont post a link to it but if you can find recent court of appeal judgements on the supreme court website, it was published only recently and the hearing was on the 6th of february. its a very good read if you are interested.

      4. Hey Ziggy, what a terrible predicament you and your partner were put through by greedy, selfish and gutless pr*cks. Are you able to file a law suit against the gutless bastards that accused your partner, or are they now a protected species? They’ve cost you and your family some very valuable time and experiences together, and that is unforgivable.

    2. Ziggy if he was wrongfully convicted – then you have a leg to stand on.

      I was sexually assaulted and held hostage and due to the ‘Burden of Proof’ laws I did not get my day in court and the assholes are free. I suffered extensively and had to learn to trust people again – due to the breach of my will. How hard do you think that was? I couldn’t work, I had two young kids.

      My relationship with my husband ended as he brought these lowlife into my life. Can’t trust him.

      Police couldn’t do what they are there to do due to evidence insufficiency – can’t trust them.

      Police tried to have me declared mentally I’ll simply because I told them in frustration that I would make a case by dealing with the offenders.

      The Magistrate’s Court denied me my right to Victim of Crime based on no conviction. Can’t trust them for help.

      So I am left to battle on my own. I am trying to build up a business and get work – but I am very conscious that my new challenge is overcoming the possibility of ‘doors closing’. I think that comes from having been kicked in the teeth by all those people that couldn’t help me when I needed it most.

      I was denied help from the ‘Victim’ arena and wound up a ‘charity’ case – and to get emergency assistance from them you have to beat the buzzer because their funds are limited.

      My family blamed me for ‘letting’ my ex have these friends. I didn’t realise I was his keeper.

  2. As a well known Victim’s Advocacy representative told me – ‘I can’t help you you aren’t dead’

    The same man calls criminals scumbags and works for the government (ie Supreme Court) for legislative reform.

    I got screwed by the criminals and screwed by the government including cops.

  3. On May 22nd 2001 my godson Jayden Jarrin Michael March was murdered one week short of his 2nd birthday. Linda Marie Wilson was supposed to protect and care for him as his foster mother instead she took his life and a part of my heart died. She was jailed but is out already and is free to live her life Jayden will never have that chance and i miss him everyday.

  4. In january 2001 my then housemates murdered 71 year old Joy alchin on the south coast of nsw they told me they were going to do it but regretably i took it as a joke they wanted her money. Joys neice Leonie Ravel knew her aunt kept her money at home and told her boyfriend peter taber who in turn told his friends shannon and ian styman they tied her with cable ties stuffed underpants in her mouth and put her head in a pillow case and robbed her….joy laid alive like that before dying 12 days later from dehydration and asphyxiation. Im glad i went to the police and i was a main witness for the crown throughout the whole process and i did get a 2 minute moment on tv after sentencing but what they did that night will haunt me forever! You can read this case in paul kidd’s second ‘never to be released’ book the story is titled left for dead

  5. Thanks for you replies Xena and Donyelle. it is for the people like you that I want to broadcast your feelings, heartbreak, concerns, let-downs, the inadequate opportunity you were cheated from in court to share your pain and so on.

    Little Jayden and the victim of your despair Xena deserve a voice.

    The point of a Victim Impact Statement is to hear those affected, the pain the loss the disbelief their loved ones are no longer with them.

    The current judiciary has been to be shown way out of touch with community expectations in this regard.

    They will listen to taxpayer paid defence testimony for days weeks and months, but when the time comes for the VIS well time rums out.

    IT is pathetic, and I ask you people to write to me in the first instance and let me know how I can give you your voice and then we can make THAT HAPPEN

  6. Hey Robbo, I think it’d be a wonderful idea for victim’s of crime to be able to have their say via this magnificent site. You’re doing a sterling job and please keep up the good work. With regards to opening the Victim’s Say comments area for replies from the general public, I think it may be best to leave it up to the original comment poster’s discretion. If they want to hear feedback and sympathy from others that have been or are in the same situation, it can only benefit both parties, but it may just be nice for them to be able to get things off their chest, a diary of sorts. Some victims aren’t necessarily strong people and may be intimidated from approaching others for help, but by being able to remain somewhat anonymous, it may be able to provide the support they need. Ultimately, the final call is yours. It might help to lay some firm ground rules regarding the aforementioned section as poster’s will be somewhat vulnerable and their feelings and thoughts should always be treated with the utmost compassion and courtesy.
    Thank you for your time, I hope I’ve helped you in making a decision.

    I have read a few comments here..(well thousands really) and yours has been one of the clearest concise honest posts I have ever read.

    I could not of replied better myself Craig…(I have a brother with the same name but your grammar is not his style, he likes to promote the invention of swear words)

    I really hope for replies like yours mate as we can only imagine what our neighbours feel. So just in case anyone needs clarification, awful crimes can happen to anyone, at any time anywhere. It is only after the fact we all start scratching our heads about how did this happen…

    Therefore that is what this is all about, thanks Craig, for such a well executed comment, I just hope what we have had to say shows those victims of crime that have been left behind feel that they have a place to voice themselves, without worrying about affidavits, legal pressures, or being discarded as irrelevant (the one that makes my blood boil)

    You deserve your statements about how the crime against you or your loved one effected you.

    So lets open your voices, no strings or legal bullshit attached by ancient court room procedures and laws…

    1. Thanks for the kind words Robbo. ( I’ve had to cut back on my swearing as my substance loses impact when the four letter words get involved ).
      After reading some posts this morning, I think it may be beneficial to have some form of a screening process run by your good self with regards to ” Victims Say “. Example – Donyelle Turner may have some serious issues so I felt it was my duty to analyse her comments regarding her actions that inadvertently aided in the subsequent demise of an elderly lady. Psychopathy, sociopathy, delusions of grandeur, bragging / boasting, self promotion et etc, the indicators are there and I’ve highlighted just one paragraph from her comments. Dave also picked up on it and bravo to him.

  8. I think its difficult to get a balance. Yes, the victims of crime suffer horribly (that story about the old woman robbed and left to die, is one of the worst of the worst).
    Reading the comments by ther poster about it, made me feel a bit uneasy. She knew of the crime before it took place, and seems to have some perverse pride in being on tele, and being mentioned in a book. With friends like those, Dony, what type of person are you?
    So you should be haunted – the whole thing was absolutely fucking disgusting. Words fail me.
    On the other hand, the old lock em’ away, and throw away the key mentality, doesn’t really work either. Its easy to fill a blog with extrerme right wing views that pander to a certain audience. What is more of a challenge, is to get off your high horse and look at society and people more broadly. If the site doesn’t have a bit of diversity, you will get people with all the same views, driving off the site people that might challenge your views. And I’ll tell you right now, if you get a site where you are all in agreement and kissing each other’s arse, it will get very boring, very quickly.

Dave, I think what Robbo is trying to achieve here is avenue/forum whereby victims of crime are able to vent some of the frustrations they endure through somewhat difficult and traumatic legal processes. Very often vicitms are powerless to project the true impact a crime has on their life, whilst the perpertrators are given every opportunity to qualify their action/s. I’ve been there via a family tragedy – still am, and to be honest having first hand experience I can assure you the impact is ongoing, seriously traumatic and bloody sad . I have also had to endure families of perps posting on-line vitriol that only adds to the trauma. To enable a victim to ‘get it off their chests’ – however it forms, can only be a good thing. By critising Donyelle, when you most likely don’t know the full story, is cruel and unnecessary. There you go – I’ve had my say.

      2. Noone cares who you are!!! Most people are judged ( rightly or wrongly ) on their actions. You’ve clearly cited instances of sociopathy and as we’ve never met you, unfortunately it is human nature to then judge you on what you have written ( actions and experiences ).Just like as judges in court don’t get to introduce themselves to the accused, sit down, have a coffee and a piece of cake, chat for a few hours etc. They hear what the accused has done ( actions ) and pass judgement on those findings. Similar to what Dave, myself and some others have done to you. Rightly or wrongly, it is human nature, so if you don’t like it, learn to write what you have to say in it’s full context so it cannot be misconstrued or keep your mouth shut and fingers away from the keyboard. And as for you being disgusted with Dave’s comments, dear child you have a lot to learn about hypocrisy. Trust me, the crime that you knew about but didn’t prevent, cost an innocent elderly victim her life, not to mention the last ( 12 ) days of her life were filled with nothing but helplessness, pain, agony and anguish and here you are complaining that Dave’s words have hurt your feelings? What about the victim, Joy? It might be time for you to get a grip on reality, recognise the faults in your ways and try to give back to the community in some way. If you can’t manage to understand anything I’ve written, it pains me to think this, but I hope Joy’s ghost haunts you and consumes your every thought, dream and moment, waking or otherwise!

I don’t set out to be an internet ‘troll’ (someone who is deliberately hurtful), but if I was your position, I wouldn’t like to put my name to that horrific killing, even if, as you say, you were only involved at the fringes. Are you seeking redemption by posting here? Do YOU see yourself as a victim of crime? If you do, some people may find that a bit rich, considering how horrible it was.
    If they were even ‘joking’ about robbing that woman, what was the purpose? Were you hungry? Junkies? Tell the the whole story, and you might get some understanding.

You can read this case in paul kidd’s second ‘never to be released’ book the story is titled left for dead. ” Seems like someone admits involvement, attempted to do the right thing after the fact, felt they should share that they were made to feel important important to the case by stating a tv appearance and duration ( like it matters – 2 mins ), then claims to be affected forever with haunting memories of the hideous act, and then has to emphasise the fact that this specific case is written about in a noted crime author’s book, names the book, and then names the chapter as if we had any doubts in their credibility. If these aren’t the signs of a delusional self righteous sociopath, I don’t know what is. And I’m not sure if this ” someone ” is purposely writing in such a specific context where the point comes across but their grammar makes for a somewhat ambiguous point of view, or whether they’re generally uneducated. All the signs are there, admission, importance, guilt, grandeur, and their legacy in the pages of history. This individual must be a tiny bit disturbed to say the least, and Dave, I’m not sure if this person has purposely omitted important information from their story, but the way it was written can be an uneducated person making some fundamental errors in their account, or a sociopath coming to the fore of their personality by only stating the facts that have any relevance to their delusion, sprinkled with morals. There’s a pattern in the writing, went to the police ( morally good ), main witness for the crown ( importance ), appeared on tv ( grandeur ), haunted by the memories of the event ( morally good ), then quotes the book title and author ( importance ) and if that wasn’t enough to gain credibility and dispel any doubt, they had to name the specific chapter ( historical notification and gratification ). Pattern – good, counteracted by bad + bad, and the same again. But, in my opinion, they’ve tried to tell a story of their involvement, been called on it, had the chance to justify or add substance to their claims, failed to do so, and is now running away from the danger ( yes, you’re the danger Dave ), with their tail between their legs all the while attempting to prove to other reader’s that they’re taking the moral high – road and not replying to your intrusive and accurate accusations any more. Wow, I think I got all that in context and in some sort of order.

  11. The only reason i mentioned the book and the chapter was because i am using my phone to write this and couldnt write the whole story! None of you know me and you dont know the whole story so you have no way of understanding the time line of what happened! I find it funny that you are placing the blame on me and not instead on the people who committed the crime. Please also do not question my intelligence, you know nothing of me or my life.

    1. Sorry Donyelle, but if you took the time to write your account as it happened and in the correct format, there wouldn’t be so many anomolies and us readers wouldn’t take things out of context. And as I’ve written above, we have never met you and can only try to understand the happenings based on your account, nothing more. Your words and your words alone have led us down this path. Maybe you omitted some crucial points or as you say, the timeline may be askew. We are blaming you as you stated that you had prior knowledge and didn’t come forth until at least 12 days after the fact. And from my understanding of your account, poor Joy was still alive for the entire or vast majority of those days. Need I go on or can you see things from some else’s perspective based on the information given?

      1. Yes i understand where your coming from but if i were to wtite the whole story i would be here all day trying to write it! I was in sydney when they killed her not at home when i arrived home they had purchased alot of new things i was suspicious as to where they got the money i asked and was told that peter(a builder) sold a shed still i didnt believe them and called my mum she told me to look around i noticed old 50 and 100 bills around that weekend leonie got a call saying her aunty was dead she didnt seem bothered tha had me suspicious my mum called me and told me the police went to her work and ask if anyone had been using old 50’s or 100’s to pay for anything mum called me and i went to the police! I did what i could if i went to the police everytime someone mentioned wanting to kill someone id be there too often people say it in jest if i for one second took their words seriously i would have gone to the police.

  12. There you go. The basic information you just gave makes it a lot clearer now. In hindsight, it would’ve been better to start off with your latest post and then none of this mess and misunderstanding would’ve ensued.

    1. Like i said im using my phone its a little harder to type on than a keyboard. They took off to queensland when they came home from a bbq and i wasnt home(i can only assume they knew id gone to the police) and i told the police about who i thought they would be staying with they were caught up there and bought back to nsw i recieved death threats on my phone while in witnrss protection away from my family and friends during a time when i was scared “just because pete cant get you doesnt mean that i wont” “you should have kept your mouth shut,now your going to pay” detectives came and saw me every 3 days. On the first day of the trial while walking to the courthouse i was punched in the back of the head by a man on the street and knocked out for a few moments he had nothing to do with the case but was caught and charged with interfering with a witness and the judge asked of i was ok and apologised for the happenings of the day. I didnt ask for any of this and it has affected my life but im glad i was able to get some justice for joy and her family. Just to add after the committal hearing the trial and sentencing they appealed and charges were downgraded from murder to manslaughter because they are saying they didnt physically kill her they just left her there and she died! The judge said theycould have saved her because being leonies aunt surely someone would find her after one or two days and when they hadnt heard anything after those few days they should have made an annomyous call to police or come forward.

  13. I meet Judith Barnes (Google her) though the Gotcha with Gary Hughes blog many, many years ago. Judith was a really fascinating person who always had a good insight into crimes outside of her own experience. Her case terrified me as a child in an extreme way, so perhaps I am in a way, a victim of media hype.

    At first reading your account of that horrific murder,I must admit I thought along the same lines as other posters.
    That you had a chance to prevent this and didn’t .
    However after being called to account and to some point attacked,you stated your case a lot more clearly.
    A lot of people would have run a million miles under this kind of personal attack,but you gave the full account and it started to make sense.

    Robbo ,may I suggest just for the sake of it , that a victims section like you have decided to do is a great idea ,however what about a separate section for replies or open slather on a subject ,where people can respond to victims comments. The reason for this would be that victims then have the choice of reading what others are saying .
    Yes they have the choice now but I think it would be near impossible to not read comments on the same page as the story is written.
    Just a suggestion mate ,it is a very difficult balancing act to get the right answer on comments to victims.
    A great move to allow victims a say.
    I am not good at putting words into writing but I hope you get what I’m trying to say here.
    Keep up the good work ,this is a great site and getting to read both points of view is wonderful .
    Your new suggestion will only add to an already great site and allow the freedom of speech we are so blessed to have in this wonderful land we call home.

        I get my 3 or 4 hours a night but then as soon as 4 am hits the clock my eyes open and that’s it.
        I am glad you have this section for victims as one day I will post how I received my injury ,done by a very high profile thug ,that is o longer with us.
        Just being a hero and aimed a gun at someone in a bar,shot it,missed him,and because I talked to the bloke a minute earlier,only ask him where the toilet was,he decided to to shoot the blokes mate in the back,,me,, for no reason other than he thought I was his mate.

    Whilst I can understand other views and feel they are entitled to them in relation to their own loved ones been punished for years and or life in jail….

    I think all victims should be able to give a side,their side,of the story.
    We have a system in place ,good or bad,it’s all we have.
    It isn’t as easy as accusing someone and the person is locked up. It doesn’t work that way.you will always find holes in any system ,that is why it is a ever changing process ,we learn from mistakes and close loop holes ,this has been going on since laws and courts were introduced.
    It will continue to go on.
    It appears your using this site and others from what I’m reading to express your thoughts as a victim of sorts,along with your brother. Yet in the same breath your saying victims shouldn’t be able to voice their side of the misfortune that befell them,you can’t have it both ways.
    The law is what it is,not perfect by no means,but a hell of a lot better than nothing or a communist type set up ,and I think this is what separates us from such places as these.
    I hope you find some peace in your own mind as from the outside it appears your only getting fed parts of a story you want to hear ,and letting love of someone cloud your judgment.
    Victims need a say. It’s not just you that can have a say.

I certainly dont feel confident enough to share my story here after reading all that. I will say tho that yes you are a victim of crime and it will haunt you for ever but just keep the chrade up that everybody else sees and continue on with life. Every now and then you will have a few mins or hours of not thinking about it. Cheers!

I know I’m partly to blame for the way you feel as my treatment of Donyelle was riddled with anger and disgust, but only until the ‘whole’ story came out. Unfortunately, Donyelle was using a mobile phone and was having trouble conveying her story / message in the context that she wanted due to that fact, but we’ve reached and understanding now that the entire story has emerged after some coaxing.   23. I was a victim of a viloent home invasion by my ex who knocked me unconcious and then shook my five moonth old son unconcious….he got 22 months.I got life…….. I still see my 5 month old son blue,limp and dropped on the floor like a peice of rubbish and feel the panic kick in with just this image. The evidence was compiled and bastard was caught some 200kms away from my then home. Roughly 10 days after the crime.

    Seven years on…. it still impacts my every moment, my every thought. The fact this prick was my sons biological father, will always taunt me and scare the living hell out of me.

    I thought by now i would stop triple chicking the locks, and have somewhat of a normal life.

    Why does he get the right to walk around with my sons name tattoo’d on his forarm, id like to take a griinder to it.

    My son has behavioural issues in which we are now working with the Womens and Childrens Hospital in Adelaide to determine weather this can be directly linked as a result of the injuries he sustained on the 21st of january 2005- the day before my second daughters birthday…she seen it all. he left her in the high chair

      I was held under Section Ten immediately and had to undergo psyche testing before they would let me go.

      This happened at a police station to which I was called to be given an adverse outcome to my reports to police.

      There was no counsellor present – there was no facilitation by process for the communication o. An adverse decision which affected my life.

      The cops and crooks are in bed together but we knew that. Or is it the Court officials and crooks. Hell – it sounds like one big friggin orgy.

    Have reported it to police. Am no longer in contact with this person but he got offered the chance to have me dealt with.

    As it was he was rambling high level ‘Underworld’ figures and one of the coldest things he said to me was ‘Do you realise what I could have done to you today if I wanted???’.

    I wonder how long it will take cops to answer – I did tell them hopefully they would be investigating my complaint rather than my murder.

  27. Defining what a victim is, can be a problem in itself, without wanting to sound insensitive. If, for an example, a person has good reason to know that a crime is about to take place by so called ‘friends’, then they they cry victim because they got too close to the action….well, you know…keep away from scumbags, and you are less likely to be a ‘victim of crime’. But that is just one scenerio of course, I’m not speaking for everybody.

  28. I think there is a certain coldness in the law in how it operates in the ‘ivory tower’ which is perhaps necessary to get at the facts. Courts are there to reach decisions – they are not a place for social work. Perhaps there is a problem in balance, but I can’t think of alternatives. I think a big misconception is that courts deliver ‘justice’…that is impossible…..how can anyone retract a rape, a murder? Except go back to the old eye for an eye concept? So, if a judge thinks a perpetrator has a chance of redemption, he will not ‘throw away the key’…..much to the disgust of a victim, or a victim’s family. Serious crimes cannot be undone. Justice doesn’t exist in the literal term. Its a comprimise between what happenned, and who is left standing.

    1. I hear what you’re saying Dave, but you have to agree, the legal system these days is far too lenient. How come 10 years doesn’t mean 10 years? Apparently it’s 6 years with good behaviour… Well, the criminal couldn’t behave themselves in normal society when it was their rite, but after they get caught committing a crime and start ‘doing time’, they learn how to behave in order to get an early release. That is not right! There’s no early release for their victim. Judges should learn to stick to their guns ( no pun intended ), and start handing out jail terms as the ‘minimum’. 10 years is just that, 10 years. I can’t be reduced, only increased. Criminals must work for their food, not just sit back and get what they’re ‘entitled’ to by law. Fuck that. No air con, no Foxtel, bread and water and a mattress on the concrete, that’s all. Jail is supposed to be punishment, not a holiday camp. They live better ( more luxuries ) than some of our hard working and honest members of society, and that’s not right. I’m sick of these do-gooder chumps talking about rehabilitation etc. No. They had the same chance to be a contributing member of society, just like everyone else, but chose to forego that opportunity for one reason or another. Why should they get another chance? Murder victims don’t get another chance. Rape victims have to go through the remainder of their lives with a death sentence ( some contract a disease, some get pregnant, some can no longer be intimate with their partner and some become suicidal or suffer depression as a result ), so why should the criminal get another chance at normality and being a functioning member of our society?

  29. I hear ya, Craig, but I think on one level, parole acts as a vacancy creator….there just aren’t enough jails, and they get overcrowded. And on another level, jails are like universities for crims. The longer they are in there, the more qualified they get! So there is a real problem in rehabilitating someone, because you only gonna get life for first degree murder. Which leads to your other point about jails being too luxurious. I’m not sure on that point too much. It could be a bit of a media beat up. But if you are going to make jail a really isolating and punishing place, with no ‘luxuries’, how is that person going to react when they rejoin society?
    Most people who commit crime (say armed hold up, for example), are likely to re-offend. The police, the justice system, are dealing with a group within a society, that no-one wants anything to do with, no idea how to punish or rehabilitate. And it will probably get worse, if poverty becomes more widespread within certain areas.

I know it’s probably a pipe-dream, but so is rehabilitation. How many parolee’s re-offend whilst on parole? Plenty. What’s the punishment? Fuck all. A smack on the wrist maybe and a stern talking to, that’s it. How does that instil fear into criminals? It doesn’t. Prison should be a place to be feared. It should be harsh with the absolute bare minimum of essentials to ensure that criminals hopefully understand just how good it is to be a member of society and the community as a whole. Maybe then prison would act as a deterrent and possibly save lives etc, which is the ultimate goal. With regards to my point on jails being too luxurious, my father has only just recently retired from the Corrective Services so I probably have a bit more insight than the average person, and yes, they do get it pretty easy on the inside. They get their meals cooked, laundry done, bills paid for, air conditioning, foxtel, need I go on? In essence, jail should be a place for potential offenders and re-offenders to fear, as they have to work for everything they receive whilst incarcerated, plus pay back a debt to the community and / or reparations to the victim and their family. And these dipshit criminals crying that they’re going on a hunger strike or going to eat razor blades as a form of protest… Really? I’ll personally buy the razor blades and sit there and watch to make sure the fucker’s eat every singly one. What rite do they have to voice their grievances and air their concerns? NONE AT ALL. Let’s face facts, they are criminals, they broke the law, they can’t function in society and their crime is proof of that. So why should we forward them any leniency for good behaviour? The victims and their families don’t get any leniency, they just have to suffer. Why should we hear the criminals voices over those of the victims? Why aren’t these offenders / criminals being forced to earn their keep whilst incarcerated? Clearly, most of them weren’t working when they committed their theft, so maybe if they were forced to earn everything they were to receive, maybe that would flick a switch or help them to understand what it takes to be a member of society. Then they’d also be too tired from working to be any form of a burden to the Correctional Officers or their fellow inmates, making a safer environment for them to serve their sentences. But oh no, the do-gooder’s, bureaucrats and those that are on the re-election campaign must hear the voices of those that are behind bars and lend a sympathetic ear to their plight, instead of asking ” So, why are you in jail? ” , or ” What crime did you commit? “, or ” So, did you think about the liberties of your victim when you were committing the crime, or has it just now become apparent that yours have been taken away? ” They say we should feel sorry for them etc and try to make their time in jail more bearable. WTF? Let’s make jail an absolute prick of a place to be, then they won’t want to go back. They can shove this humanitarian garbage straight down their own throats. Their tune will change when they or someone they know becomes the victim of crime and then they see the offender get a very light sentence imposed in stark contrast to the sentence forced upon them and their loved ones.

    1. Making a lot of sense to me, thinking of jails in places like Thailand,Bali ,amongst others.
      Why is it that more people take a chance at drug smuggling etc,into Australia than vice versa ,I’d suspect that the incoming smugglers to Australia wouldn’t try the same thing into these other places,for one simple reason.
      The jails in those places are the deterrent,the jail system and penaltys in Australia are in most cases better than what they have in normal life at home.
      I’m thinking if I was a drug smuggler and was asked to smuggle into either aus,or one of the hell holes,I now which I would be picking.
      I’m aware the choice wouldn’t happen,to take a pick at which country to smuggle into,but I’m trying to make a point of the reasons why a logical thinking person would not want to do time in these other places.
      How rare is it to hear someone has been caught smuggling into these places,it happens,rarely, but nowhere near the amount caught trying to do the same into Australia.
      What is the deterrent when your given better conditions than what you live in everyday at home.
      Make a million or spend 10 years in better conditions than home.
      Or make a million but if caught face death by hanging or firing squad,in conditions that are mostly unbearable.
      Just drawing a contrast of the two jail systems here and why you have people take a chance in Australia,but will not take that same chance in Thai,or Bali.

We are seen as a ‘soft’ target for overseas criminals, not to mention those from this great country. Yet, I fear the term ‘great’ as being misrepresented with regards to the fluffy treatment of those incarcerated in our current prison system. It is no longer a place to be feared, more of just a stepping stone, which is nowhere near where it should be in terms of punishment.

  31. My honest opinion, is that once someone gets into the jail system, luxury version or spartan, its probably too late to rehabilitate that person. Shit, a person who is unemployed for awhile has difficulty getting back in the flow of things, how would an ex-con go? And there are all sorts of opinions on this, but long jail sentences, even death sentences, suggest that is not a deterrant. Why? Because people don’t commit a crime to get caught. They are either career criminals, junkies, or commit a crime of passion or revenge, such in the case of murder or rape. Fear needs to be installed more at the coal face ie: the police force. I’m not ancient, but I remember a time when cops were fearsome big blokes, who made you shit scared. Now, their heirarchy says that taking some level of assault off the public is to be expected. WTF! They used to dish it out, and now they have become a joke. Nothing any good can come out of jails, unless you are locking away the Ivan Milats of the world, who you know won’t come out. But the what is the difference btween a guy serving 6 or 10 years? Six years is still a fucking long time (it would be for me, anyway), so either way, you end up with damaged goods, and a menace to society unless they are locked away for good. And they are just not gonna do that for every rape, assault, or manslaughter.

But, regarding your comment / thought on an unemployed person rejoining the workforce being akin to a criminal rejoining society, this just puts pay to my comment re ‘ spartan living for inmates ‘. Hence they ‘ must work ‘ for anything other than bread and water. This will hopefully give them a sense of self-worth and possibly promote a more responsible attitude when it comes to thing like personal appearance, personal hygiene, and a more respectful attitude to the term ‘ working for a living ‘. They may also possibly gain a reference from their employer ( the jail ), which would hopefully give prospective employers a genuine insight into who the person is, plus a working history for the most recent amount of time spent behind bars. I know this sounds like nothing more than a pipe-dream, but it’s a far more pro-active approach than giving them their ‘ entitlements ‘ and ‘ rites ‘. Inmates should give up all civilian rites once convicted, and be forced to abide by the terms of a work contract, or survive on bread and water, whilst watching the other inmates work and be able to afford certain luxuries for themselves as reward for working hard. And once again, the sentence handed down from the judge should be a MINIMUM, 10 years means 10 years, not 6 years with goo behaviour. The sentence may not be reduced for any circumstance, but may only increase with regards to breaching the aforementioned work contract.

  32. Nothing is really feared anymore, including the police, who are front-line. Though I think they might be having a gutful, going by the recent incidents regarding tasers, and a guy getting shot. By the time you get to prison, your life is pretty much destroyed anyway, luxury or not. Some people can come back from the experience, but its not an easy thing to have on your resume.

If you make prison conditions harsher, it also runs the risk of creating a harder criminal. I wouldn’t want to be in a jail, even if they had 24 hour whores available. Just the idea of incarceration does it for me. And I think the average ‘do right’ citizen misunderstands the basic pyschology of a prisoner. They are doing time cause the got caught. Harsher treatment in jail, does not necesarily act as a deterant to someone committing crime, or make a better citizen once they are released. The opposite could happen, in fact.

I know there are some genuine ‘ down on their luck ‘ individuals inside the prisons, and they should be dealt with in an entirely different manner. Hard assed crims with other hard assed crims, and unfortunate inmates with other unfortunate inmates, ie short – stay inmates. What I am showing, however, is a blatant disgust for the current legal and penal systems that we have in place in this country, as I believe they’re far too soft compared to other countries like Thailand, Bali etc, as quoted by Johnny in a previous comment. I think it’s time for some stern punishment to those convicted of specific crimes ( please forgive me, I have no idea how to grade or separate certain crimes from others ) and re-offenders etc. Why can’t we adopt a 3 Strikes rule? If you get arrested and convicted 3 times ( and it doesn’t have to be for the same thing nor does a time limit apply ), then you’ve had your chances and the criminal has proved that they’re beyond rehabilitation and / or that they’re an habitual offender, and we have no place for people like that in our society. Everyone else can seem to manage to do the right thing. Does that make my stance and thoughts clearer Dave?

  45. It wasn’t exactly what i meant, Xena. What ‘pitfalls’, and what ‘loopholes’ do their lawyers exploit? People misunderstand what the ‘justice’ system is. Its not there to right a wrong, or turn back the clock.
    Obviously, to those who are victims of crime, they would love to dish out their own summary justice -but this is yet another fantasy. We don’t live in Pakistan, where the hand of a thief is cut off. Although I’m sure some people would love it! We come from a long tradition of the British legal system, where people are treated with proprietry and objectiveness.
    I understand the anger that victims of crime feel. Whether their business or home has been robbed, and a loved one has been murdered. But a court cannot ‘unmake’ these actions. The expectations are too high. And unless we leave our traditions behind, and embrace a more summary based system (or mob rule), we are stuck with the flaws of the one we have. And nothing will prevent the ‘churning’ of offenders (offenders repeating their life of crime), because some, are just dumb-ass crims, who know no better, and neither do the people they hang out with. Some people are just wrong’uns…and nobody knows what to do with them. Its a fact of life.

  46. Xena..I’m not trying to be ‘right’. It is obviously a very complex area, and if I’d ever been a victim of crime, I might come across differently. I’m just trying to give a broad overview how the criminal justice works…or doesn’t work in the eyes of victims. You mentioned spiritual centres earlier….I think those sort of places are better suited to victims than perpetrators. There, you might be able to get over some hurt and anger, and find some inner peace. Because dwelling on the person who hurt you, is ultimately hurting yourself. I think the father of that young woman Anita Cobby, was involved in something like that for himself and other victims of crime.
    Summary justice does occur sometimes, but not in court. I heard that the ringleader and murderer of Anita Cobby, got a novel treatment in jail. It involved placing a length of barbed wire inside a plastic tube, then the plastic tube was put in his anus. Then the plastic tubing was removed, and finally the barbed wire………..

  47. Being a crime vicitm I can assure you that we are treated worse than the offenders in the criminal justice system. Offenders are offered lesser sentences for pleading guilty, giving evidence, sob stories ie. ‘had a tough childhood’, prospects for rehabilitation etc., and then in many cases appeal their sentences successfully. Victims struggle to find support within the system and it makes the process of healing all that harder – the imbalance of it all is very difficult to comprehend. I agree that there should be levels of incarceration dependent on the crime, reoffending etc. Rehabilitation is good in theory, but I know from excellent sources that it is pretty much non-existent within the prison system. Many study law (Julian Knight etc) and find loopholes and then waste more public money only to cause their victims even more trauma!!!!!! Perhaps what should be considered is informing victims of what rehabilitation is in place for the offender and monitoring progress – it wont work for all and fo course vicitms could choose/or not to particpate. My feelings are that ultimately the law is soft and acts as no deterrent, you only have to look at some kids as young as 8/10 yrs thumbing it at the police, knowing they can’t be touched. We should be looking at preventative measures by engaging with people that work with disengaged youth to lessen the escalation of crime overall. It would most likely take a generation to see results but worth it in the long run.

Hey everyone, first of all, please let me say a massive ‘ thank you ‘ to Robbo for opening up a new forum where we can vent our ideals, thoughts and opinions from past experiences and those instances and crimes that we’ve read or heard about via the media. I would also like to apologise to Robbo for somewhat inadvertently hijacking this forum and straying way off topic. I’m sure there are others on here that are guilty of the same ( pun intended ). This is supposed to be a format for the victims of crime, their families and friends to use to air their grievances, thoughts and feelings in order to bring awareness to situations that need addressing within the system, that most of us are unaware of, and hopefully be the catalyst to start or continue their healing process now knowing that their voice has been heard. Lastly, I’d like to thank Dave, Johnny, Xena, Billy, Carmel etc for their input. I’m glad to know that there are others out there that are as passionate as I am re our procedures and protocols that are currently making a mockery of our judicial system. The opinions and views that have been expressed have been mature and topical and have never ventured to a personal attack for a difference of opinion or view, or understanding of certain things, and for that, you should all be applauded.

  49. What happens in society, often results in how and why people end up in jail. Kids 8-10 out roaming late at night, multi-generational welfare – housing commission estates……I don’t want to look I’m picking on the poor, but obviously attitudes are hardened well before someone finds themselves in the criminal justice system. This leads to problems with rehabilitation programs. They didn’t care before, so will they suddenly care, just because they are in jail, with a bunch a well-intentioned but naive social workers/pyschologists around them? And while some might sound dumb, and can’t spell, etc, they are very crafty in their own way. Of course they will use the system. Some perhaps becoming very literate, and learning about the law that put them there in the first place! No easy answer on this one, folks. But suffice to say, what happens on the outside, forms the attitudes of the convicted, once they hit jail.

  51. Its hard to get the bottom of that one. She claims she heard that they might hurt/rob the old lady, but did nothing. They were friends/ aquantances of her’s. Just the way she made sure we knew what book and page number in a true crime book, certainly got me suspicious. She may well be having bad feelings about it now. But I think she is mixing up this site with the true crime genre you get in books and on telly, that has popular. It was such a horrific case, I’d only be mentioning if I was a close relative, and feeling devestated, if I was her. I remember the case well, but I didn’t want to hear about her little hurts, and reminder us at the same time, she made it into a true crime book. Just doesn’t seem genuine.

  53. The victim was Joy Alchin. There are two stories I found. She was known to hoard large amounts of cash at home. Everyone would have known about it, including our ‘victim of crime’ Donyelle Turner. What she did or didn’t do with that knowledge, is unknown.

  55. Dave, I don’t necessarily disagree with what you’re saying in terms of kids roaming streets at night etc but I reckon that’s just scratching the surface. In our situation the majority of offenders (older youths) came from well to do families and appear to have been caught up in a gang culture scenario – didn’t even know the victim. It absolutely made no sense what happened and what ensued was a life lost and a family destroyed. Going through the criminal court system is an eye opener, and having firsthand knowledge I can assure you it seriously favours the offenders. The sentences handed out in our case were ‘mostly’ pitiful due to the age of the offenders and their prospects for rehabilitation. I’d be keen to know what rehab was in place for these offenders and/or would like to have a say in how it is administered. I guess what I’m trying to get across is that criminals stem from all walks of life, and yes, a reasonable percentage from generational welfare areas, but also from ethnic groupings – greed and dominance also play a major role – many are just plain bored and looking for some excitment and/or believe they are owed something from society for their lot in life. As I was trying to get across in my early post, it is my belief that many of these problems can only be resolved from intervention in the early stages ie. Engaging with youth, integration into society, decent social workers/counsellors placed in schools, including primary. There are many things that can be done with more government funding in all these areas to assist in reducing future crime statistics. Only problem is the governments won’t listen. Engaging with people at the coalface would be a good start – think Les Twentyman, Salvation Army Crossroads and the like.

    1. I’d take it a step further too Carmel ,I reckon there should be some system in place in the prison system that would see cases like Julian knights first have to meet a criteria. It would pay to have a judge or panel of sorts here the appeals that the likes of knight are forever tying up our courts with,and if they are frivolous then they don’t even make it to the court house.
      So for the likes of him,have retired judge or a panel or whatever is needed,and they would decide whether or not the appeal for stuff like laptops in his cell is warranted,if so,it goes ahead to the courts ,but if not,then that’s it. Sort of a mini system to weed out time and money wasters. There is real people in need of court time and real criminals that the courts have to get through,,time wasters like knight and co with frivolous complaints should it be tying up the courts.
      Not prison appointed panels either,as it would or could be open to favouritism of sorts one way or another. Independent panel to make the decisions that the judges get bogged down with..
      Just a thought to stop time wasters.

Its sick, and I think she thinks she is some kind of minor celebrity in the true crime genre. I think she is pea-brained and pathetic. Attention seeking. She’s not ‘traumatised’. Its all a big act.Robbo has also posted something on the net about her susdpicious behaviour. Google her name.

    1. Yeah,just done as you said dave,didn’t realise she has been a frequent flyer,,that shot my theory down then. Thought she had only posted the couple of comments,but now see clearly what your both saying,and now agree ,should do more reading before I give benefit of doubt or look to some other reason,like someone else posting as her,which it clearly isn’t.
      Grandstanding at others expense and posting as a victim is pretty pathetic ,now seeing clearly ,and don’t like it at all. Real victims need a say,not people saying they are victims,only to grandstand ,very poor and really should be ashamed of her comments now,which is maybe why she hasnt put her case forward again,as there is really no case to put forward,not in my books anyway.

  57. Carmel, social workers (except for ones like Les Twentyman) are useless as tits on a bull. If, as you say, crime is not poverty based, and comes from all walks of walks of life, why would bored kids listen to anyone? If they smartarsed little trouble-makers, they are like it from a young age, and they don’t listen to anyone in authority. If their parents can’t control them, no-one will.
